01 · About Our Business

Overview

Welcome to Stronsay Forge.

This website, www.stronsayforge.com , is operated by Nathanael MacTaggart, a sole trader trading as A Farm In The North. Stronsay Forge is the blacksmithing and artisan craft brand of that business, based on the island of Stronsay, Orkney, Scotland.

Throughout these Terms of Service, the words "we", "us" and "our" refer to the business operating as Stronsay Forge.

By accessing our website or purchasing products from us, you agree to these Terms of Service, together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

These terms do not affect your statutory consumer rights.

Our online store is hosted by Shopify, which provides the ecommerce platform through which we sell our products.

02 · Handmade Craftsmanship

Our Products

Stronsay Forge produces handmade and hand-finished goods, including traditional ironmongery, metalwork, jewellery, knives, tools and other craft products.

Many of our products are individually made rather than mass-produced.

As a result, slight variations in dimensions, hammer marks, texture, colour and finish may occur between pieces.

These variations are a natural characteristic of handmade craftsmanship and do not necessarily constitute a defect, provided the product is as described and meets applicable quality standards.

We make reasonable efforts to ensure product descriptions, photographs and prices are accurate.

03 · Purchasing From the Forge

Ordering & Payment

By placing an order through our website, you are making an offer to purchase the selected products.

Orders are subject to acceptance, payment authorisation, product availability and any applicable legal requirements.

An automated order acknowledgement does not necessarily constitute acceptance of your order. We may decline an order before acceptance for legitimate reasons, including stock availability, payment issues, suspected fraud or legal restrictions.

If payment has already been taken for an order we cannot fulfil, we will arrange an appropriate refund.

All prices are displayed in pounds sterling (GBP), unless otherwise indicated.

Delivery charges and any applicable taxes will be displayed during checkout.

We reserve the right to amend product prices, but changes will not affect orders already accepted.

04 · Made by Hand

Handmade & Made-to-Order Products

Some products are made individually following an order.

Estimated preparation times may vary depending on the product, current workload and availability of materials.

Where applicable, estimated preparation and dispatch times are provided during checkout or otherwise communicated to the customer.

Because our products are handmade, minor differences between individual items are to be expected.

Products made to order from our standard range remain subject to applicable statutory cancellation and return rights.

05 · Individual Commissions

Bespoke & Personalised Products

We may accept bespoke commissions and requests for personalised products.

Specifications, pricing, estimated completion times and other relevant details will be agreed before work begins.

Items made to a customer's individual specifications or clearly personalised may be excluded from statutory change-of-mind cancellation rights where permitted by law.

This does not affect statutory rights relating to faulty, damaged or incorrectly described goods.

Where a commission requires a deposit or other specific payment arrangement, the applicable conditions will be communicated and agreed before payment.

06 · Responsible Purchasing

Knives, Axes & Age-Restricted Products

Certain products sold by Stronsay Forge are subject to age restrictions and other legal requirements.

Customers purchasing age-restricted products must meet the applicable minimum legal age.

We may require appropriate age verification before accepting, processing or dispatching an order.

We reserve the right to refuse or cancel an order where legal requirements cannot be satisfied.

Customers are responsible for ensuring that the products they purchase may lawfully be imported, possessed and used in their destination jurisdiction.

We may restrict shipping destinations for particular products where required by law or carrier restrictions.

Nothing in these terms permits the unlawful sale, delivery or possession of restricted items.

07 · From Stronsay to Your Door

Shipping & Delivery

Orders are dispatched from Stronsay, Orkney, Scotland.

Shipping charges, available delivery methods and estimated dispatch times are provided through our website and checkout.

Our location on a remote island means that severe weather or ferry cancellations can occasionally affect postal services.

We will make reasonable efforts to keep customers informed of significant delays.

Full details are available in our Shipping & Delivery Policy.

08 · Your Consumer Rights

Returns, Cancellations & Refunds

Returns, cancellations and refunds are handled in accordance with our Returns & Refunds Policy and applicable consumer protection legislation.

Eligible customers may have statutory rights to cancel distance purchases, as well as rights where goods are faulty or not as described.

Our additional 30-day returns arrangement applies subject to the conditions stated in our Returns & Refunds Policy.

Nothing in these terms excludes or limits statutory consumer rights.

09 · Website Accuracy

Product Availability & Information

We aim to keep product availability, descriptions, pricing and other website information accurate and up to date.

Occasionally, errors or omissions may occur.

Where an error affects an order, we will contact the customer where appropriate and explain the available options.

We may update or discontinue products and website content without prior notice, but this will not remove rights arising under orders already accepted.

10 · Using Our Website

Customer Responsibilities

When placing an order, customers agree to provide accurate and complete contact, payment and delivery information.

Customers must not use our website for unlawful purposes, fraudulent transactions or activities that interfere with its operation or security.

Customers purchasing knives, tools or other potentially hazardous products are responsible for using and storing them safely and lawfully.

11 · Original Work & Designs

Intellectual Property

Unless otherwise stated, the original photographs, written content, artwork, designs and other creative material published on this website belong to Nathanael MacTaggart or are used with permission.

Content may not be reproduced, commercially exploited or distributed without appropriate permission, except where permitted by law.

Product purchases do not transfer intellectual property rights in the underlying designs or creative works.

12 · External Services

Third-Party Services & Links

Our website may contain links to external websites or use third-party services, including Shopify and payment or delivery providers.

Third-party websites and services may operate under their own terms and privacy policies.

We are not responsible for the independent content or practices of external websites outside our control.

13 · Personal Information

Privacy & Personal Information

Personal information collected through our website is handled in accordance with our Privacy Policy and applicable data protection legislation.

Our Privacy Policy explains how personal information is collected, used, stored and shared, together with your data protection rights.

14 · Legal Responsibilities

Liability

Nothing in these Terms of Service excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms limits your statutory consumer rights or remedies for goods that do not meet applicable legal requirements.

Subject to those protections, we are not responsible for losses that are not reasonably foreseeable or are caused by circumstances outside our reasonable control.

15 · Circumstances Beyond Our Control

Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including severe weather, transport disruption, ferry cancellations or other significant interruptions to essential services.

Where such events affect an order, we will take reasonable steps to minimise disruption and communicate with the customer.

Your statutory rights remain unaffected.

16 · Updates to Our Terms

Changes to These Terms

We may update these Terms of Service from time to time.

The latest version will be published on our website with an updated revision date.

Changes will not retrospectively remove contractual or statutory rights arising from orders already accepted.

17 · Applicable Law

Governing Law

These Terms of Service are governed by the laws of Scotland.

Nothing in these terms removes any mandatory consumer protection rights that apply under the law of your country of residence.

Consumers may bring legal proceedings in a court with jurisdiction under applicable law.
